# Consumer Terms of Use

In this document, references to “ProdIDPass”, the “platform” and “we” in connection with the operator’s rights and obligations mean WISHTECH, a French SAS (société par actions simplifiée), SIREN 878201367, with registered office at 11 RUE DE LOURMEL, 75015 PARIS, France, operating the service under the ProdIDPass brand. ProdIDPass is used below as the operator’s shorthand name without changing its legal identity.

These Terms govern your access to and use of the consumer-facing ProdIDPass website, accounts, Digital Product Passport (DPP) features, wallet and credential functions, reviews, Trust Points, support tools and marketplace services (the **Service**). The operator identified in the Legal Notice (**ProdIDPass**, **we**, **us**) provides the Service. A professional seller remains responsible for goods it sells, as explained in the Terms of Sale.

By creating an account or using the Service, you agree to these Terms. If you buy goods, the Terms of Sale and seller-specific information also apply. The Acceptable Use Policy forms part of these Terms. The Privacy Policy explains personal-data processing. Mandatory law prevails over any inconsistent term.

## 1. Eligibility and accounts

You may browse public pages without an account where the Service permits. You must have legal capacity to accept these Terms. A minor may use the Service only with the involvement and authorisation of a parent or legal guardian, and may not place an order unless applicable law permits it.

Give accurate, current information; keep credentials and recovery methods secure; and notify **[consumer support contact]** promptly of suspected unauthorised access. You are responsible for activity you authorise, but not for activity caused by our failure to apply legally required security. Do not share an account or impersonate another person. We may require proportionate identity, age, address, eligibility or anti-fraud checks.

## 2. Marketplace role and sellers

ProdIDPass supplies marketplace and technical services. Unless the checkout expressly identifies ProdIDPass as seller, your sales contract is with the professional seller named on the product page, at checkout and in the order record. Seller status, identity, contact details and the allocation of contractual responsibilities must be shown before purchase. A DPP, badge, trust score or verification record does not make ProdIDPass the seller and is not an endorsement or guarantee.

## 3. Listings, search and commercial communications

Sellers are responsible for their listings and mandatory product information. Search results may depend on query relevance, selected category and locale, availability, publication status and other parameters disclosed near the results. Promotions or paid placement must be identifiable as such. If a result order or recommendation uses materially different parameters, the interface should explain the principal parameters and their relative importance.

Product images and DPP data may help identification and traceability, but do not replace the seller's description, labels, instructions, warnings or recall notices. Report materially inaccurate or unsafe information through the appropriate support or reporting channel.

## 4. DPPs, credentials and ownership functions

Public DPP data may be viewed and shared subject to law and the Acceptable Use Policy. Credentials and ownership functions can help evidence a relationship with a product. They are not the exclusive proof of legal title, do not by themselves transfer physical ownership, and do not replace invoices, consumer guarantees or official registers.

Keep wallet access, one-time codes and credential offers confidential. Check the intended issuer, holder and product before accepting or transferring a credential. A transfer may be irreversible once completed. We may refuse, pause or revoke a credential operation where technically invalid, unauthorised, fraudulent or legally prohibited, while preserving any mandatory right relating to the underlying goods.

## 5. Reviews, votes and user content

Where reviews are available, submit only genuine, relevant experience and disclose any incentive or material relationship. A “verified purchase” label means only that the Service matched the review to an eligible transaction under the disclosed verification method. Review ordering, verification, moderation, publication delay, retention and refusal criteria should be explained in the review interface.

You retain rights in content you submit. You grant us a non-exclusive, worldwide, royalty-free licence, for as long as reasonably needed, to host, reproduce, format, translate, display and moderate that content solely to operate, secure, improve and evidence the Service. The licence ends when content is deleted, except for lawful backups, dispute evidence and content independently shared by others. You confirm that you have the necessary rights and that the content complies with the Acceptable Use Policy.

## 6. Trust Points and eligibility

Trust Points are an in-Service reputation or participation measure. Unless expressly stated otherwise, they are personal, non-transferable, not redeemable for cash and not a financial instrument. Disclosed rules may award, spend, reverse or adjust points for actions such as reviews, votes or corrections. Some offers may disclose a minimum score before purchase. We may correct errors or manipulation, and will provide an explanation and review route where a decision materially restricts your access.

## 7. Intellectual property

The Service, its software, design, databases, trade marks and operator-created content are protected by intellectual-property law. We give you a limited, revocable, non-exclusive and non-transferable right to use the Service for personal, lawful consumer purposes. This does not permit copying the Service, circumventing controls, extracting a substantial part of a database, commercial reuse, reverse engineering except where law permits, or use of our marks without permission.

## 8. Availability and third-party services

The Service may depend on sellers, payment providers, carriers, credential issuers, hosting, email and authentication providers. Their terms may apply to their own services. We aim to maintain availability and integrity but do not promise uninterrupted or error-free operation. We may perform maintenance, correct errors, change non-essential features or discontinue a feature. We will give reasonable notice of a material adverse change where practicable and required, and will not use a change to remove accrued consumer rights.

## 9. Enforcement, suspension and termination

We may restrict content, transactions or access where reasonably necessary to protect users, investigate fraud or security issues, enforce these Terms or comply with law. Measures should be proportionate to the nature, frequency and consequences of the conduct. Where legally required, we will give affected users a clear statement of reasons, including whether automated tools materially contributed, and information about available review or redress. Immediate action may be taken for urgent safety, security or legal reasons.

You may stop using the Service and request account closure. Closure may not delete order records, credentials, public content, fraud evidence or other data that must be retained or is lawfully required for claims, safety or compliance. The Privacy Policy explains this further. Provisions intended to survive termination, including accrued rights, intellectual property, evidence and liability terms, continue to apply.

## 10. Responsibility and liability

Nothing in these Terms excludes liability or a remedy that cannot lawfully be excluded, including mandatory consumer rights, liability for fraud, or liability for death or personal injury caused by negligence where applicable. We are responsible for direct loss that was reasonably foreseeable and caused by our breach. To the extent permitted by law, we are not responsible for loss caused solely by a seller, your unauthorised use, inaccurate information you supplied, or an event beyond reasonable control. Any statutory responsibility of an online marketplace remains unaffected.

## 11. Complaints, law and changes

For service complaints use the Complaints and Mediation page. For illegal content use the Illegal Content Reporting page. These Terms are governed by French law, without depriving you of mandatory protection or courts available in the country of your habitual residence.

We may update these Terms for legal, security, operational or feature changes. The current version and effective date are displayed above. A material change affecting an existing account will be notified reasonably in advance where required. Changes do not retrospectively alter completed sales contracts.

## Chats about goods and services

Chat lets buyers and sellers discuss goods, services and prices before ordering. It is not a formal quotation issued by the platform and does not itself create an order or collect payment; express commitments between the parties may nevertheless be legally binding. Online conversations and attachments require sign-in. Where a product offers an initial guest enquiry, it grants no online history, reply or attachment access. Signed-in enquiries show the account display name, without automatically disclosing email or telephone details to the seller; you may voluntarily send your own contact details.

The recipient is an organization whose authorized members may jointly handle the conversation, rather than one particular employee. Read/unread status records system access: one authorized member may clear the organization's shared unread indicator; it does not prove that everyone or a particular person read the message. Closing chat stops new messages in that conversation; it does not delete history, cancel orders, certify performance or waive statutory rights. Chat is not an emergency service and has no immediate-response guarantee. Use order and support channels for refunds and disputes.

Review heat indicates participation intensity based on accumulated Trust Points committed, rather than review count, professional certification or a platform guarantee. Neither small nor large commitments permit fabricated transactions or rating manipulation.
