Consumer Marketplace Terms of Sale
In this document, references to “ProdIDPass”, the “platform” and “we” in connection with the operator’s rights and obligations mean WISHTECH, a French SAS (société par actions simplifiée), SIREN 878201367, with registered office at 11 RUE DE LOURMEL, 75015 PARIS, France, operating the service under the ProdIDPass brand. ProdIDPass is used below as the operator’s shorthand name without changing its legal identity.
These Terms of Sale apply when you buy physical goods or supported services as a consumer through the ProdIDPass marketplace. A consumer is an individual acting mainly for purposes outside their trade, business, craft or profession. If you buy for professional purposes, mandatory consumer rights may not apply and the supplier's business terms may govern instead.
These Terms supplement the goods/service page, checkout summary and order confirmation. The supplier's identity, purchased scope, price, delivery or performance arrangements and specific conditions shown for the order form part of the agreement. Mandatory consumer law prevails over any inconsistent term.
Services, unpaid records and external transactions
These Terms also govern supported services purchased through platform payment. Provisions about physical delivery, return of goods and product guarantees concern goods; they do not automatically require a service to be returned. Review the provider, scope, actual service country, communication language, quantity, price or starting price and final total. A starting price is not a promise that every requested job costs that amount; agree the scope and review the order amount before paying. Quantity describes what is purchased, without a platform appointment calendar or work-time certification.
Saving an unpaid order records your request and locks its cart selection; it does not collect money. The seller may revise its price or close it before payment. Reopening checkout shows the latest total and requires your payment confirmation and current Terms acceptance. An earlier price is not guaranteed. Payment confirms the displayed amount; extra work requires another order and reductions use refunds. Contract formation ultimately depends on applicable law and the parties’ actual agreement, not the database label alone.
For distance service contracts, the usual 14-day withdrawal period starts from contract conclusion, subject to applicable law. The provider must obtain and retain your express request before starting early. A lawful proportionate charge for work already supplied may apply. Loss of withdrawal after full performance requires the legally necessary prior express consent and acknowledgement; urgent home repairs have a limited exception. Payment, Terms acceptance or a seller’s completion click alone is not such consent. Use the order’s withdrawal/refund function to submit an unambiguous notice without quality evidence; a receipt records its content and time. Seller review of the amount is separate from receipt of your notice. Full or partial refunds and disputed decisions use the same order process. Mandatory rights remain unaffected.
A seller may declare an unpaid record externally completed where the parties arrange an external transaction. This records the seller’s declaration, not verified principal payment or performance. The platform neither collects that principal nor issues its consumer invoice or processes its refund; arrange these with the actual provider. The provider may owe the platform a referral fee. No fee-collection or external-completion label changes mandatory rights or the actual legal relationship. Contact platform support about an inaccurate platform record. Any external-record Trust Points remain pending until both the waiting period and actual collection of the provider’s referral fee are satisfied; the record is not a verified platform-paid purchase.
Where available, deleting an unpaid order cancels it and hides it from the customer's list; it does not restore the cart or constitute a personal-data erasure request. Sellers and the platform may lawfully retain cancellation and audit records. Paid, processing and externally completed orders are ineligible. Cancelling an unpaid record does not undo other agreements already binding by law.
Service scope and country restrictions
The platform does not accept cross-border services directly related to immovable property, such as construction, repairs, architectural design or site supervision for a particular property. Such services may be offered only in the provider's verified country of establishment, with the property also located there, and remain subject to supported tax rules and publication review. General advice is not automatically a property-related service merely because property is mentioned; the actual work determines the classification. This is a platform admission policy, not a statement that all cross-border property services are unlawful. Do not bypass it through inaccurate addresses, relabelling, chat or external-completion registration.
Customers may browse and discuss services without selecting a country in chat. Checkout determines the service country from the billing/contact address; this does not change the property's actual location or applicable tax law. Providers must accurately describe their territory, scope, required qualifications and insurance, and enable only languages they can actually use. Publication or identity review does not certify professional competence, service quality or each transaction's tax treatment.
1. Your seller and the role of ProdIDPass
Your sales contract is with the professional seller identified on the product page, at checkout and in the order confirmation or invoice. That seller is responsible for the goods, pre-contract information, order fulfilment, delivery, legal guarantees, withdrawals, returns, refunds, product safety and after-sales service.
ProdIDPass provides the marketplace, checkout, payment-orchestration, support, traceability and Digital Product Passport tools. ProdIDPass is not the seller unless the checkout and order records expressly identify the marketplace operator as the seller. When ProdIDPass receives a notice or support request concerning an order, it may record, route and track it on the seller's behalf. This allocation of responsibilities does not reduce any right you have against the seller or any responsibility the marketplace operator has under mandatory law.
2. Product and pre-contract information
Before placing an order, review:
- the seller's identity and contact details;
- the goods' essential characteristics, selected options, quantity and compatibility information;
- the total price, including VAT or other applicable tax, delivery charges and any discount;
- available delivery destinations, method and estimated or agreed delivery time;
- any minimum Trust Points or other eligibility requirement disclosed for the product;
- the availability and conditions of after-sales service, commercial warranties and digital updates, where applicable; and
- any withdrawal exception, return cost or product-specific restriction disclosed before purchase.
Product photographs may show presentation or context, but the product description and the options recorded in your order determine what you buy. Contact the seller or marketplace support before ordering if material information is missing or unclear.
A Digital Product Passport (DPP), credential, certification record or traceability entry may provide useful evidence about a product. It does not replace the seller's description, mandatory labels, instructions, safety warnings, recall notices or legal obligations. If DPP data conflicts with the order confirmation or information supplied with the goods, contact the seller promptly.
3. Prices, VAT, discounts and eligibility
Prices and currency are shown before you place the order. The checkout summary calculates the product total, delivery charges, applicable VAT or other tax, discounts and final amount payable using the delivery and billing information you provide. You must review the final total before confirming.
Prices, stock, promotions and delivery charges may change before an order is placed. A promotion or coupon applies only if the checkout confirms that it is eligible. Unless expressly stated otherwise, coupons and Trust Points are personal, have no cash value and cannot be combined, transferred or applied retrospectively. If an eligibility requirement is not met, checkout may prevent the order from being placed.
If the checkout calculation contains a manifest error, the seller or ProdIDPass will contact you. An order may be corrected or cancelled only to the extent permitted by applicable law. If a cancelled order has already been charged, the amount due will be refunded without undue delay.
4. Placing an order and formation of the contract
The cart records an unpaid request. Review the current amount and Terms before platform payment. The section above on services, unpaid records and external transactions defines this workflow; mandatory law and any actual agreement remain controlling.
5. Payment
Payment is processed by the payment provider identified in the payment flow. The payment provider's own terms and privacy notice may also apply. ProdIDPass and the seller normally receive payment references, status and limited transaction information rather than full card details.
You must use a payment method you are authorised to use and provide accurate billing information. A payment may be authorised, declined, delayed or subject to legally permitted fraud and security checks. A payment confirmation page or paid status records payment; it does not waive any withdrawal, conformity or refund right.
6. Delivery
The seller will deliver to the address accepted at checkout and within the time agreed in the order information. If no delivery time has been agreed and French consumer law applies, delivery must normally take place without undue delay and no later than 30 days after the contract is concluded.
You are responsible for providing a complete, accurate and accessible delivery address. Contact support promptly if you notice an error; an address cannot always be changed after dispatch. The seller may use split shipments where reasonably necessary and without charging more than the delivery total agreed at checkout.
If delivery is late, lost, damaged or incomplete, contact the seller through the order support channel. Where mandatory law requires, you may set an appropriate additional delivery period and, if the seller still does not deliver, cancel the contract and obtain a refund. No additional period is required where the seller refuses delivery or delivery by the agreed date was essential under applicable law.
When the seller or its offered carrier transports the goods, the risk of loss or damage normally passes when you, or a third party you nominate other than the carrier, takes physical possession. If you independently appoint a carrier that the seller did not offer, risk may pass when the goods are handed to that carrier. Reporting visible damage promptly helps the seller investigate but failure to do so does not remove your mandatory rights.
7. Statutory right of withdrawal
Legal reference: Directive 2011/83/EU Articles 9 and 11; where French law applies, Code de la consommation Article L221-18.
If EU or equivalent national distance-selling rules apply, you normally have 14 days to withdraw from the sales contract without giving a reason. For goods, the period generally starts on the day after you or a nominated third party other than the carrier receives them. If one order contains several goods delivered separately, the period generally starts when the last good, lot or piece is received. Mandatory national rules may provide additional rights.
To withdraw, send an unambiguous statement before the deadline through the order support channel or directly to the seller using the contact details in the order confirmation. You may use the model form at the end of these Terms, but it is not compulsory. If the online form asks for a reason, entering “statutory withdrawal” is sufficient; you do not have to explain your decision. Seller approval is not a condition of a valid withdrawal notice.
The statutory right of withdrawal may not apply in circumstances defined by law. Examples include goods made to your specifications or clearly personalised; goods liable to deteriorate or expire rapidly; and sealed goods unsuitable for return for health-protection or hygiene reasons after unsealing. Other statutory exceptions may apply to particular categories. An exception applies only where its legal conditions are met and the relevant information was given before purchase.
8. Returning goods after withdrawal
Legal reference: Directive 2011/83/EU Article 14; where French law applies, Code de la consommation Article L221-23.
After notifying withdrawal, return the goods to the address and according to the reasonable instructions provided by the seller, without undue delay and normally within 14 days after sending your notice. Do not send goods to the marketplace operator unless the return instructions expressly tell you to do so.
You bear only the direct return cost when the seller informed you before purchase that this cost was yours. The seller bears the cost where it agreed to do so, failed to provide the required advance information, or the goods are incorrect, damaged or non-conforming and applicable law makes the seller responsible.
You may handle the goods only as needed to establish their nature, characteristics and functioning, as you reasonably could in a shop. You may be responsible for diminished value caused by handling beyond that, but only where the law permits and the required withdrawal information was provided.
9. Withdrawal refunds
Legal reference: Directive 2011/83/EU Article 13; where French law applies, Code de la consommation Article L221-24.
Following a valid withdrawal, the seller must refund all payments covered by the withdrawal, including the cost of the least expensive standard delivery method offered for the order. Any extra cost resulting from your choice of a more expensive delivery method need not be refunded where the law permits.
The refund must be made without undue delay and, where French or EU consumer law applies, no later than 14 days after the seller is informed of your withdrawal. Unless the seller offers to collect the goods, it may withhold the refund until it receives the goods or you provide evidence of return, whichever occurs first. Refunds use the original payment method unless you expressly agree otherwise, and the alternative must not cause you fees.
10. Cancellations, returns and refunds outside withdrawal
The order page may let you request a full or partial refund for selected order lines, describe the issue, follow the seller's decision and, where required, submit return-carrier and tracking information. The seller may request reasonable evidence needed to assess damage, non-conformity, delivery problems or another claim.
All professional sellers using the ProdIDPass marketplace must follow the platform Return Policy published at /returns. It provides a common 14-day return workflow and does not replace or reduce any longer or stronger mandatory right. For an ordinary withdrawal, you bear the direct return cost only where this was disclosed before purchase. The seller bears required return costs for incorrect, damaged or non-conforming goods. A platform status such as “submitted,” “approved,” “return required,” “in transit” or “refund processing” records workflow only. It cannot make a statutory withdrawal or legal remedy conditional on discretionary approval, and it cannot shorten a mandatory deadline.
For an approved return, follow the return address, deadline and instructions recorded for that request. Keep proof of dispatch. Where the seller waives return, you do not need to send the goods back. A credit note may be provided for a completed full or partial refund.
11. Legal guarantee of conformity
The seller must deliver goods that conform to the contract and to mandatory objective requirements, including any applicable requirements concerning functionality, compatibility, durability, safety, instructions and updates. The DPP, an ownership credential and any commercial warranty do not limit this obligation.
Where French consumer law applies, the seller is liable for a lack of conformity that appears within two years after delivery, including for used goods, subject to the rules applicable to the particular product and any goods with digital elements. Other mandatory national law may provide equal or stronger protection.
If goods are non-conforming, contact the seller through the order support channel and provide the order reference and a useful description of the issue. Depending on applicable law and the circumstances, you may be entitled to repair or replacement without charge and within a reasonable time, or to an appropriate price reduction or cancellation and refund. The seller bears required costs of bringing goods into conformity, including shipping, labour and materials where the law so provides.
Any commercial warranty is additional to the legal guarantee and must identify its guarantor, duration, territorial scope and claim procedure. Rights concerning hidden defects and product liability remain available where applicable.
12. Safety, recalls and digital elements
Follow the safety, installation, care and update instructions supplied with the goods. The seller or manufacturer may contact you about a safety warning, corrective action or recall. Stop using a product and follow the stated safety procedure when instructed. Public DPP data can support traceability, but the absence of a DPP alert does not establish that a product is safe or not subject to a recall.
For goods with digital elements, the seller remains responsible for any mandatory digital content, service and security updates required to keep the goods in conformity for the applicable period. Separate digital-service terms may apply where clearly disclosed before purchase, without reducing mandatory rights in the goods.
13. Ownership and product credentials
Physical delivery, legal ownership and any digital ownership credential are distinct. An ownership claim link or credential may become available after payment or shipment and can help demonstrate a relationship to a product, but it is not the exclusive proof of legal title and does not alter the legal transfer of risk, ownership, warranty or consumer remedies. Keep your order confirmation and invoice as transaction records.
14. Complaints, mediation and courts
For a product, delivery, withdrawal, return, refund, conformity or warranty issue, contact the seller identified in the order. You may also contact ProdIDPass support so the matter can be routed and tracked. Include the order number, relevant dates, the outcome requested and only the evidence needed to assess the issue. Do not provide passwords or full payment-card details.
If a written complaint is not resolved, consult the Consumer Complaints and Mediation page and the seller-specific information supplied with the order. Where French consumer law applies, you may have the right to use the competent consumer mediator free of charge after first making a written complaint to the professional. You may also contact a competent consumer authority or court.
French law governs these Terms and the sales contract, subject to mandatory protections that apply in your country of habitual residence. Nothing in these Terms deprives you of the right to bring proceedings in a court available to you under mandatory consumer-jurisdiction rules.
15. Version and changes
The version accepted and recorded with your order governs that order. A later revision does not retrospectively change an existing sales contract unless you expressly agree or the change is required by law and may lawfully apply. If any provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
